Kennedy Reid works with clients, candidates and business partners across several worldwide locations. In order to conduct our business effectively we may be required to transfer your personal information to any country where we (or our clients, candidates, business or service providers) operate, which includes the United Kingdom. We may also share your personal information with overseas recipients who may handle, process or store your personal information on our behalf. We only ever share your personal information outside of Australia where we are permitted to do so under the Privacy Act. Generally, this means that we will take reasonable steps to ensure your personal information is treated securely and in accordance with applicable privacy laws. What is personal information?

Sensitive information is a specific category of personal information. It includes personal information of a more ‘sensitive’ nature, such as information or an opinion about your:
Racial background or ethnic origin
Membership of a political association or religious beliefs, affiliations or philosophical beliefs
Membership of a professional or trade association or membership of a trade union or political opinions
Criminal record
Sexual preferences or practices
Health, genetic or biometric information.
In specific circumstances, we may collect sensitive information under applicable privacy laws. We only ever do this to the extent such sensitive information is relevant to our functions and activities, and in accordance with applicable privacy laws.
What personal information do we collect and hold about you
We collect and administer a range of personal information for administration and business purposes. The kinds of personal information we collect and hold about you will depend on the circumstances in which it is being collected, including whether we collect the information from you as a job seeker, employer, contractor, supplier or in some other capacity. The information we collect from you may range from general information (e.g. contact details) to sensitive information (e.g. medical history). We may also collect the opinions of others about your work performance, information about your work experience and qualifications, psychometric test results and other information obtained by us in connection with your potential work placement(s).
How we collect and hold your personal information
Personal information is normally collected from you directly, when you submit your registration with Kennedy Reid or provide any other information in connection with your application to us, for example a resume.
You may submit your resume and personal details to Kennedy Reid via our website registration service, either for general consideration by our consultants for positions as they arise or to apply for a specific advertised job.
Once submitted, your resume and personal details will be recorded in our database. Information can be stored electronically or in hard copy format. This information can be accessed by Kennedy Reid consultants at any time.
On occasion, we may also collect personal information about you from other people and organisations. Personal information is also collected when:
We receive any references about you
We receive results of enquiries that we might make of your former employers, work colleagues, professional associations or registration bodies
We receive any results of any psychometric or medical test or assessment
We receive any performance feedback (whether positive or negative)
We receive any complaint from or about you in the workplace
We receive any information about a workplace accident in which you are involved
We receive any information about any insurance investigation, litigation or professional disciplinary matter, criminal matter, inquest, or inquiry in which you are involved

How and why we use your personal information
We collect personal information that is necessary to provide you with our services, and to carry out our business. We may use your personal information for purposes which are incidental to the sale and promotion of our services, or for other purposes which are within your reasonable expectation or permitted by law. Your performance appraisals
Our assessment of your ongoing performance and prospects
Any test or assessment (including medical tests and assessments) that you might be required to undergo
Our identification of your training needs
Any workplace rehabilitation
Our management of any complaint, investigation or inquiry in which you are involved
Any insurance claim or proposal that requires disclosure of your personal information
We may also use information about you for research, benchmarking, studies, trend analysis and to improve and enhance our services or develop and market new services. Any published end product will refer only to larger aggregations of individuals and will not identify you personally or include any results attributed to you.
We may also use your personal information to send you direct marketing communications to keep you informed about our services which we think might be of interest to you based on your interactions with us, or as otherwise allowed under applicable privacy laws.
We may communicate with you through various channels, such as regular mail, email SMS, telephone or social media. We will only send these communications in accordance with applicable privacy and marketing laws (such as the Privacy Act (including Australian Privacy Principle 7), and the Spam Act 2003 (Cth)), and only where you have not opted out from receiving such communications from us.
You are always in control of the direct marketing communications which you receive and can opt out at any time. Generally, you can opt out by following the relevant opt out or unsubscribe instructions in the relevant communication. You can also contact us using the contact details below to tell us that you would like to stop receiving direct marketing communications from us. Importantly, regardless of whether you opt out from receiving any or all direct marketing communications, we will still communicate with you if we are required by applicable law to provide you with information, or in relation to the services we are providing you.

How do we store and protect your personal information?
We are committed to protecting your personal information, and ensuring that we securely store any personal information we collect (and in accordance with applicable privacy laws). We may hold your personal information in hard copy (paper) or in electronic form. We take all reasonable steps to ensure that any personal information we collect, use or disclose is accurate, complete, up-to-date and stored in a secure environment protected from misuse, interference and loss, and from unauthorised access, modification or disclosure. We maintain physical security over paper and electronic data stores, such as through locks and security systems at our premises. We also maintain computer and network security; for example, we use firewalls (security measures for the internet) and other security systems such as user identifiers and passwords to control access to our computer systems.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy or as required to comply with any applicable legal obligations. When we no longer require your personal information (and in accordance with any applicable laws), we will take steps to delete, destroy or re-identify that information.
What if you do not give us the information we require?
If you do not give us the information we require:
We may be limited in our ability to locate suitable work for you
We may be limited in our ability to proceed with any recruitment processes
We may not be able to proceed with your application for employment or placement in a specified area.
Gaining access to, and seeking correction of, your personal information
Subject to certain exceptions that are set out in the Australian Privacy Principles, APP 12 ‘access to personal information’ and APP 13 ‘correction of personal information’, on request you may access to the personal information we hold about you and request its correction.
If you are able to establish that personal information that we hold about you is not accurate, complete and up-to-date, we will take reasonable steps to correct it so that it is accurate, complete and up-to-date.
If we are unable to agree that personal information that we hold about you is accurate, complete and up-to-date, you may ask us to place with the information a statement by you that claims that particular information is not accurate, complete and up-to-date.
We may ask to verify your identity or seek more information about your request. Where we are legally permitted to do so, we may refuse your request and give you reasons for doing so. Where you request for personal information to be updated and there is a dispute about the facts, we will make a note on your personal information of such a dispute. You may also request that Kennedy Reid stops using your information and contacting you and we will comply with your request, subject to our obligations under applicable laws.
If you wish to access or correct your personal information that we hold about you, you should contact our Privacy Officer whose details are shown at the end of this document. Kennedy Reid may charge a reasonable administration fee for providing access to personal information. We will not charge you simply because you lodge a request for access.
How you can make a complaint about the handling of personal information

Please also contact is if you have a complaint about privacy. If you make a complaint about privacy, the following will occur:
We will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint. We will generally acknowledge your complaint within a week.
If your complaint requires more detailed consideration or investigation:
We will acknowledge receipt of your complaint within a week and endeavour to complete our investigation into your complaint promptly; and
We may ask you to provide further information about your complaint and the outcome you are seeking.
We will typically gather facts, locate and review relevant documents and speak to the individuals involved.
In most cases, we will respond to your complaint within 30 business days from when we receive your complaint. If the matter is more complex or our investigation may take longer, we will let you know.
If you are not satisfied with our response to a complaint, or you consider that we may have breached the Privacy Act (including the Australian Privacy Principles), you are entitled to make a complaint to the Office of the Australian Information Commissioner (“OAIC”). What we won’t do
Kennedy Reid will not charge a job seeker a fee for the purpose of finding the job seeker employment
Kennedy Reid will not engage in misleading or deceptive conduct (such as advertising a position as being available when the agency knows no such position exists, or knowingly giving misleading information to a job seeker about the nature of the position).
If you believe that Kennedy Reid has acted inappropriately or illegally, you may contact the appropriate Australian dispute resolution body (ACCC or the Commonwealth Ombudsman) for information on possible action that may be taken. If you aren’t based in Australia you may contact the local governing body charged with protecting consumers (e.g. UK: The Office of Fair Trading; USA: Federal Trade Commission; Singapore: Ministry of Trade & Industry).
